OVERVIEW Welcome to Golden Kapp! The terms “we”, “us” and “our” refer to Golden Kapp. Golden Kapp operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Golden Kapp is powered by Shopify, which enables us to provide the Services to you.

SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage. To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current, and complete.

SECTION 2 - OUR PRODUCTS & FOOD SAFETY We have made every effort to provide an accurate representation of our products. However, as our chocolates are handcrafted, slight variations in appearance, weight, and texture may occur. Allergen Warning: Please be aware that our products are manufactured in a facility that handles nuts, dairy, soy, gluten, and wheat. While we label our products, there is always a risk of cross-contamination. Customers with severe allergies consume our products at their own risk. Storage: You are responsible for storing the products in a cool, dry place (ideally between 15°C - 20°C) immediately upon receipt. We are not liable for spoilage due to improper storage after delivery.

SECTION 3 - ORDERS AND CASH ON DELIVERY When you place an order, you are making an offer to purchase. Golden Kapp reserves the right to accept or decline your order for any reason. Cash on Delivery (COD): If you select COD as your payment method, you agree to be present at the delivery address to pay the full amount in cash or via card (if supported by the courier) upon delivery. Refusal to accept a confirmed COD order without valid cause may result in your account being blacklisted from future orders. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export unless explicitly authorized by us in writing.

SECTION 4 - PRICES, TAXES AND BILLING Prices, discounts, and promotions are subject to change without notice. VAT: As a UAE-based business, all prices are inclusive of the 5% Value Added Tax (VAT), unless stated otherwise. Prices posted in our online stores may be different from prices offered in physical stores or other platforms. You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our stores.

SECTION 5 - SHIPPING, DELIVERY AND MELTING RISK Temperature Control: We take every precaution to ensure your chocolate arrives in perfect condition. However, given the high temperatures in the UAE, you must ensure someone is available to receive the package immediately. Liability: We are not liable for spoilage or melting if:

  1. You provide an incorrect address.

  2. No one is available to receive the package on the first delivery attempt.

  3. The package is left outside or with security/concierge at your request. All delivery times are estimates only and are not guaranteed.

SECTION 6 - INTELLECTUAL PROPERTY Our Services, including but not limited to all trademarks, brands, text, images, graphics, and product designs, are owned by Golden Kapp and are protected by United Arab Emirates and international copyright laws. You must not reproduce, distribute, or create derivative works of any of our material without our prior written consent.

SECTION 7 - OPTIONAL TOOLS You may be provided with access to customer tools offered by third parties as part of the Services (e.g., map services, payment processors). We provide access to such tools “as is” without any warranties. Any use by you of optional tools is entirely at your own risk.

SECTION 8 - THIRD-PARTY LINKS The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for the content or accuracy of any third-party materials.

SECTION 9 - RELATIONSHIP WITH SHOPIFY Golden Kapp is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Golden Kapp. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Golden Kapp, including any injury, damage, or loss resulting from purchased products and services.

SECTION 20 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Arab Emirates and the courts of the Emirate of Dubai.
